Welcome to Oasis Climate. These Terms of Service ("Terms") govern your access to and use of the Oasis Climate platform, including our website, simulator, and any related services (collectively, the "Service").
Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
IMPORTANT NOTICE: BETA SERVICE
You acknowledge that the Service is currently offered as a "Beta" version. This means it is provided for testing and evaluation purposes. The Service may contain bugs, errors, and other problems. We strongly advise you not to rely on the Service for any critical or high-stakes decisions regarding your heating system, energy consumption, or home safety.
Oasis Climate is an experimental, advisory platform designed to help you understand and explore the thermal behavior of your home. The Service uses a "Digital Twin" model and simulation tools to provide suggestions and insights.
The Service does not control your heating system. All actions and decisions based on information from the Service are taken at your sole discretion and risk.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial purposes.
You agree not to misuse the Service or help anyone else to do so. You agree not to:

You retain all ownership rights to the data, information, and content you submit to the Service ("Your Content").
To operate and improve the Service, you grant Oasis Climate a worldwide, non-exclusive, royalty-free license to use, process, reproduce, and analyze Your Content solely for the purpose of providing, maintaining, and improving the Service. This includes using anonymized and aggregated data to train our algorithms and enhance our models. Our use of your personal data is governed by our Privacy Policy.
All rights, title, and interest in and to the Service (excluding Your Content), including all associated intellectual property rights, are and will remain the exclusive property of Oasis Climate and its licensors.
Any feedback, comments, or suggestions you may provide regarding the Service is entirely voluntary. You agree that we will be free to use such feedback as we see fit and without any obligation to you.
This is a fundamental part of our agreement.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
OASIS CLIMATE MAKES NO WARRANTY AND DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL OASIS CLIMATE, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF OASIS CLIMATE EXCEED THE GREATER OF THE AMOUNT YOU HAVE PAID OASIS CLIMATE, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.
THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT OASIS CLIMATE HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE.
You agree to defend, indemnify, and hold harmless Oasis Climate and its developers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
You can stop using our Service at any time.
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, for any reason, including for a breach of these Terms.
Upon termination, your right to use the Service will immediately cease. As described in our Privacy Policy, we will provide you with an opportunity to export your data before proceeding with its deletion or anonymization.
We may revise these Terms from time to time. The most current version will always be posted on our website. If a revision, in our sole discretion, is material, we will notify you. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms.
These Terms constitute the entire and exclusive agreement between you and Oasis Climate. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
